Terms and Conditions of MONOMAX Application Service

To protect members’ rights, please read all terms and conditions of the service and agree to abide by all terms and conditions as follows:

Definition

MONOMAX Service means service available for members who can view contents, movies, series, TV programs correctly and legitimately through the streaming system, or download via internet to viewing device, such as mobile phones, computers, TV and other devices that can be connected to the internet, and also includes ancillary services or any additional services that members agrees to accept from the service provider. Member means person agreeing to subscribe for service of the service provider. Service title means MONOMAX.

1. Scope of Service

The following terms (“Terms of Service”) is an agreement between members and website: www.monomax.me and MONOMAX Application, which includes all contents, use of money and provision of services on the Website www.monomax.me and MONOMAX application available on Android, iOS, HarmonyOS and/or other operating systems that MONOMAX provides service, provided that members shall adhere to by accessing or using MONOMAX website or application, or www.monomax.me (“Website or Application”) under supervision of MONOMAX by Mono Streaming Company Limited (“MONOMAX”), i.e. members have agreed to accept that the agreement, terms and conditions of service as shown on the website or application have legally binding effect (“Conditions”), and members agree to accept and comply with the privacy policy of the website or application, and agree to abide by other rules on the website or application, such as methods of use, practices and procedures or conditions for accessing or using service of MONOMAX website or application. This also covers all members who can view copyrighted contents, movies and series online via internet streaming, or download to viewing device, e.g. mobile phones, TV and other devices as specified by MONOMAX, including ancillary services or any additional services that members agree to receive from MONOMAX by using or receiving service on the platform which serves as medium between members as interested persons, as well as members or persons wishing to view contents, movies, series and television programs through MONOMAX service by viewing contents, movies, series and various television programs through MONOMAX website or application or various platforms under the conditions specified by MONOMAX.

2. Membership

Members shall agree and comply with the terms appearing in membership terms and conditions and these terms of service or any additional revisions in the future, and members’ acceptance to use MONOMAX service will be deemed that members have given consent and accepted these terms and conditions as well.

MONOMAX content and services are only available in Thailand. And commercial use or any use that may affect other members are prohibited.
Membership terms and conditions: These terms and conditions of application service are in accordance with the membership terms conditions. By answering the questions, it will be considered that members have accepted the terms and conditions of service, and the membership terms and conditions, and terms and conditions of application service shall apply.
MONOMAX shall be able to change membership terms and conditions, and terms and conditions of application service as appropriate, and the terms and conditions of application service will be published on MONOMAX website or application.
Members are obliged to visit the application periodically and review contents of any changed and published terms and conditions. If members have accessed the service after the publication of such change, it shall be considered that members have accepted and agreed to the change in contents, and MONOMAX shall not be responsible for any damages against members arising from the failure to acknowledge the content of terms and conditions.
Members shall attain the age of 18 years or become sui juris in order to subscribe for the service and view MONOMAX contents. Members aged below 15 years old on the day of service use shall be under supervision, consent or guidance of their parents (legitimate representative or guardian) in order to understand the terms and conditions of service. In this regard, for convenience of service use, the day that members have accepted the terms and conditions of MONOMAX service shall be deemed as the day that their parents have implicitly accepted and permitted the terms and conditions of service as well.
Members are required to register their membership by filling out name, surname and Personal Data, and follow the subscription process using true formation.
MONOMAX Service is intended for personal use, and commercial use or use for public performance are prohibited.
Members shall be solely responsible for MONOMAX member account. Accessing the service or performing any action through MONOMAX member account by other persons shall be regarded as the use of the service by account holder.
Members shall not and shall not allow other persons to collect, copy, reproduce, distribute, modify, publish, create, imitate, offer for sale, advertise, decrypt, encrypt, or perform any action to interfere with the content, information and software under MONOMAX service.

3. Details of Service

Subscription for MONOMAX Service

Members are able to subscribe without any cost to access MONOMAX service by applying via mobile phone number, e-mail, User ID, or link information to the members’ personal Facebook account. Members acknowledge that by subscribing and linking MONOMAX with Facebook, members agree to the terms and conditions, and allow the service provider and other persons to collect members’ information, such as name, e-mail address and other permitted information.

Free Trial Service

Use of MONOMAX service without cost or fee waiver or free trial will depend on the service provider’s conditions that offer waiver of payment for the service as specified only. Such right may be granted to persons who subscribe and purchase the package for viewing through a designated channel. The system will charge subscription fee from members for the next billing cycle based on payment method when the free trial period ends, except in the case of cancellation of membership prior to the end of free trial. In this regard, the service providers may terminate the right to free trial for persons who do not meet the eligibility criteria, whereby eligibility verification may be done free of charge by verifying subscription account, ID of the access device, and payment channel that has been previously subscribed or used.

Purchase of Packages

Members will be able to watch unlimited movies, series or TV programs from MONOMAX service when a package has been purchased.

Movie Packages Based on Payment Channels

For monthly package (30 days) and yearly package (365 days) with automatic renewal of package according to cycle through credit card payment channel, including the purchase of packages through payment intermediaries (such as credit card) on the website: www.monomax.me, members agree to automatically set off the balance according to the cycle in order to pay service fee when it is due, and cancellation can be done at any time. The package may begin with a promotion, such as a free trial for first-time subscriber, purchase of special price package during the specified period, whereby promotional period will be specified during the purchase of package or subscription to use the service.
For monthly package (30 days) by making payment through mobile phone number, members agree to automatically set off the balance according to the cycle in order to pay service fee when it is due, and cancellation can be done at any time.
For top-up code or promotional code by purchasing via online channel or obtaining top-up code from other partners or agents, members shall purchase or obtain a code to fill out and start using service on MONOMAX website, whereby service will be offered based on validity term and condition of each code.
For monthly package (30 days) and yearly package (365 days) with automatic renewal of package according to cycle through payment application, money will be charged through ID account of operating system provider on members’ mobile phone. When agreeing to purchase a package, members will be able to view for a period of time as specified. When such period ends, the system will renew and deduct service fee automatically within 24 hours.
- If automatic renewal is no longer required, members shall deactivate automatic renewal feature at least 24 hours before the end of subscription period.
- Payment can be managed by activing/deactivating automatic renewal at the user account settings after selecting and purchasing the package.
- If the automatic renewal is deactivated, the system will not be able to receive payment, and members will not be able to receive the service from the cycle that payment is not made.
- After cancelation of service by members, members can still receive MONOMAX service until completion of remaining days of validity.
- By making payment through account ID of mobile operating system provider, it will be considered that members have understood and accepted the terms and conditions of billing system. The service provider shall not be responsible for damages or expenses incurred to members from such action.
For one-time package without automatic renewal or package with automatic renewal through other payment intermediaries, MONOMAX service provider may have other payment intermediaries available based on channel and price as specified by MONOMAX service provider. The billing terms and format of package may vary depending on each channel, and members will be able to view and pay MONOMAX service fee based on the package they have selected.

Remark

: When members have purchased the package and received a free trial service, members will no longer be able to use free trial service again.
: If the payment is not successfully made for any reason, the service provider reserves the right to suspend the service until service fee will be paid, and may change payment date as deemed appropriate, whereby members agree that service fee will be charged automatically according to the conditions as specified, and member shall remain responsible for the amount owed.

Access

The number of devices that can be accessed at the same time per 1 account depends on the conditions of the package. Members must read the terms and conditions before purchasing.

Service Provision Standard

The service provider will make our best efforts to ensure that members can always use the service throughout the contract period. Members acknowledge and accept from the beginning of service subscription that the provision of service under this agreement has a limitation that may affect the quality of service. This limitation includes, but is not limited to, service area, speed of broadband internet service, number of members for the time being, condition and distance of members’ internal telephone line, capacity of computer, internet traffic in the network, distance and quality of network provided, capacity of ADSL modem or router, capacity of service device (server) of other service providers, as well as other factors that the service provider is unable to control. Members agree that MONOMAX shall not be liable for any damage or loss arising from the interruption of service provision or from the use of service by any reasons. MONOMAX shall be entitled to amend any terms or conditions of service, as well as monthly fee and other fees by giving written notice to members in advance.

4. Content of Service

MONOMAX shall not be held liable for retention of any information or usage information of members who fail to use the service for intended purpose, or breach terms and conditions of service, or breach Thai laws or international law governing and accepted by other countries.

MONOMAX will provide service according to the terms and conditions of service or pursuant to Thai laws international law governing and accepted by other countries in order to provide website and application prepared or licensed to MONOMAX for its members.
In the case that MONOMAX needs to add any content to the application service, or for the necessity of application management, members agree that MONOMAX has the right to make such change from time to time by updating it online and offline.

5. Account and Password

MONOMAX will provide account and password to members as specified by MONOMAX members using English characters and/or Arabic numerals in digits as specified in order to activate account and password for members’ access to the service. This is the only method that MONOMAX will use to distinguish its members.

Account and password will be managed by MONOMAX to protect members’ Personal Data.
Members agree to be responsible for keeping their account and password confidential without disclosing to any person, and be liable for any damage from the use of service and testing in the event that such Personal Data is stolen by electronic means, or lost, damaged due to force majeure or in any event. Members who are responsible for taking care of their account shall be entirely liable, and MONOMAX shall not be held liable in any way.
MONOMAX shall have no involvement or responsibility for any use, purchase, sale, lease, borrowing, transfer, permission or use as guarantee, sharing, or transfer of right to account and password in any form.

6. Personal Data of Members

Collection Members give consent for the Company to access, collect and use personal data which has been recorded or filled in the system or any document issued by government agencies, and/or collected by the Company from other sources or persons in accordance with applicable laws, date of birth, address, phone number, e-mail, Facebook, record of product or service purchase, as well as provision of information through inquiry or interaction with MONOMAX, such as feedback, critique and inquiry submitted by members.
Purpose of Collection, Use and Disclosure of Personal Data Members agree and accept the collection, use and disclosure of personal data for the following purposes:
- (a) To comply with agreement made between members and the Company, fulfill member’s request before entering into that agreement, comply with agreement between MONOMAX and other persons for the benefit of members, process information to improve the efficiency of products and services, arrange or market products, services and benefits, arrange sales promotion activities, research, analysis and marketing surveys, prepare statistical data, present new products or services for members as a whole;
- (b) To process information to improve the efficiency of products and services, arrange or market products, services and benefits, arrange sales promotion activities, research, analysis and marketing surveys, prepare statistical data, present new products or services for individual members, whereby MONOMAX will use such data in accordance with the purposes and for maximum benefits for members. In this regard, the collection and use of such data is in accordance with the criteria and policies specified by the company and permitted by applicable laws.
Disclosure of Personal Data Members agree and accept that MONOMAX may disclose personal data to group companies of Mono Next Public Company Limited, including Mono Shopping Company Limited, Mono Broadcast Company Limited, Mono Production Company Limited, Mono Cyber Company Limited, other group companies, associates, branch companies, related companies, suppliers, service providers, shops, strategic partners, contactors of MONOMAX in and outside the country, in order to proceed in accordance with the purpose as specified in Item 6.2, as well as auditors, external inspectors, and government agencies as prescribed by laws.
Retention Period of Personal Data Members agree and give consent for the Company to use their personal data throughout the term they remain members, and allow the Company to destroy or anonymize personal data within 90 days from termination of membership unless we cannot do so because it is necessary for us to maintain under any agreement involving other persons or as prescribed by laws.
Rights of Personal Data Holder Members are entitled to view and receive a copy of their personal data that the Company has collected, used and disclosed. If personal data has been obtained by the Company without members’ consent, members are able to request the Company to disclose the method of data acquisition. In the event that MONOMAX collects personal data from other sources, such as social media or websites, etc., members are entitled to request for deletion or destruction of information, suspension or anonymization of information. In the event that members terminate membership or MONOMAX does not use personal data in accordance with intended purposes, members are entitled to request for suspension of use, or request for correction of their personal data to ensure that it is correct, complete and up-to-date, by contacting the Company through communication channels as follows:

Effect of Not Providing Personal Data Members are aware that failure to provide personal data will prevent them from becoming MONOMAX members.

7. Members’ Responsibility and Duty

Do not cause MONOMAX trouble.
Do not disclose information of MONOMAX without MONOMAX’s consent.
Have duties and other liabilities in accordance with applicable laws.
Do not disseminate personal data of their own and others in public domain, and do not publicize articles, statements, images or anything that is slanderous, inappropriate, obscene, rude or offensive.
Do not commit any offence under any law, and do not infringe any intellectual property or other rights in any form.
Comply with the terms and conditions of this service or other applicable laws.
Do not import or send or release virus or engage in any hacking activity.
Do not act in a way that obstructs MONOMAX work and application service.
Do not commit fraud against MONOMAX.
If members find that the service is used in a way that breaches these terms and conditions or any laws by their account or password, the members shall notify MONOMAX immediately. If it is found that such use of service resulted from members’ negligence, MONOMAX shall not be held liable.

8. Payment Conditions of Service Fee

Payment made in the system may be in form of credit provision, or payment may be made by using other currency, or form of payment as specified by MONOMAX, and members will be able to make payment through various channels as specified by MONOMAX.

9. Request for Cancellation and Service Cancellation Channel

Cancellation Members are able to cancel their package at any time, and once the package is canceled, members can still access the service until the end of billing cycle. Service fee, discount, trial days and service days during inactive period or period that content is not be viewed on MONOMAX, will not be returned.

When subscribing for the package through credit card payment channel on the website, you can cancel the package at the “Personal Data” menu on the website: www.monomax.me;
When subscribing for the package through application channel or an ID account from mobile operating system operator, please deactivate automatic renewal at user account settings on the device. If automatic renewal is deactivated, the system will not be able to receive payment, and members will not be able to receive the service from the cycle that payment is not made. After members have canceled the service, members can still receive MONOMAX service until completion of remaining days of validity.

10. Term and Change of Service Provision Right

MONOMAX has the right to temporarily discontinue its services due to necessity or inevitable cause or other emergency issues, such as inspection, maintenance, replacement or breakdown of computer or computer equipment, and MONOMAX annual holidays, which will be announced in advance. This shall include other events of force majeure under the laws.
In case of necessity for MONOMAX service, maintenance or inspection of network equipment and system, MONOMAX will perform regularly inspection according to the schedule as specified on the website.
MONOMAX reserves the right to amend, change, suspend, terminate or discontinue the service, temporarily or permanently, without prior notice to users. However, the service provider may suspend or postpone the permission to use service in the following events as well
In the event that the service provider is unable to perform full service;
In the event that an error occurs with software and hardware of service providers and members;
In the event of an error occurs during payment and verification of service fee;
Maintenance and construction of service that involves software, hardware and electronic communications equipment;
Inability to provide service due to natural disaster and other events of force majeure;
In case of emergency for protection of other members or third parties, or for complete security of information, MONOMAX shall not be liable for damages against members or other persons as a result of such suspension, postponement or change of any rights.

11. Termination of Service Provision

MONOMAX has the right to terminate the service without prior notice if members perform any of the following acts.

Use of messages that defame other persons, damage reputation or dignity of other persons;
Use of profane words or abusive words or statements that negatively implicate other persons’ parents;
Harassment and damage against the service;
Use of messages supporting corrupt acts;
Violation of other persons’ rights or infringement of MONOMAX rights;
Violation of these terms and conditions or applicable laws or customs or public morality;
Use of images, contents or other intellectual property without permission;
Use of statements intended for any benefit without permission from MONOMAX;
Use of messages containing offensive content or profanity;
Use of obscene messages or images;
Use of advertisement that does not relate to the application by directing to other websites;
Use of other application advertisement, and any attempted acts inducing to other applications;
Use of advertisement to promote illegal websites or undesirable websites;
Make false or misleading information about MONOMAX;
Impersonate as the management or staff of MONOMAX;
Use of top-up method in a fraudulent manner;
Failure to pay service fee within the period of time as specified, or MONOMAX is unable to verify payment due to wrong payment made by members, and in such event, top-up amount or payment of service fee will not be refunded in any cases, either in whole or in part;
Members’ subscription by filling out false information or using other persons’ information;
Members do not use the service over extended period of time as specified;
Termination of service at any time by giving notice to members or service provider in advance.

12. Exclusion of Liability

MONOMAX shall be exempted from responsibility in the event that MONOMAX is unable to provide service due to events of force majeure.
MONOMAX shall not be liable for any suspension or defect in the use of service as a result of any legal effect or illegal conduct by members.
MONOMAX has the right to waive liability in the event of an electrical and telecommunication failure.
MONOMAX exempts its liability in the event that the service is discontinued due to inevitable events, such as correction, change, inspection and construction of equipment for service provision that has been announced in advance.
MONOMAX shall not be held liable in the event that its members are unable to make profit as expected, and damage from selection of service or use of service by members.
MONOMAX shall not be responsible for delayed login and damage arising from delayed connection.
MONOMAX shall not be held liable for the reliability and accuracy of the publication of membership terms and conditions, terms and conditions of application service under the copyright of MONOMAX, and information and facts on the service or on the website.
MONOMAX shall not be obliged to address any problems among members, or between members and third parties. MONOMAX has no responsibility for any damages incurred.
Part of the service may include the provision of other MONOMAX services. MONOMAX shall not be responsible for any damages caused by other MONOMAX services.

13. Limitation of Service

All accounts and passwords and other information in the accounts are the property of MONOMAX, regardless of whether such information is acquired by any means by which MONOMAX only grants users the right to use accounts and passwords within the service period only; and MONOMAX reserves the right to change, restore, suspend or terminate accounts and passwords at any time if the service contract between MONOMAX and copyright owner has been modified, expired or terminated, including in accordance with the terms and conditions of service, without prior notice, and MONOMAX shall not be liable for damages incurred to users or other persons from doing so.
MONOMAX shall not be held liable for any problems arising among members.
MONOMAX shall be able to suspend the use of members’ account if members’ obligations are violated due to the use of account in a wrongful manner by third parties, or damage has been caused against members because account and password are leaked during the use of service while being under the care of members.
MONOMAX shall be able to suspend the use of the account and all data in the application by members when consideration is made based on suitability of controls and schedules of application.
MONOMAX is the holder of all rights and powers in all information in members’ application. In the event that MONOMAX recognizes the need to control or improve the application, MONOMAX shall be able to make any addition, removal or modification.
For topping up through any channels, members shall not be able to cancel, request for refund, exchange or make correction.

14. Intellectual Property Right

MONOMAX owns or has exclusive intellectual property right over MONOMAX Application. All works or information on this application, whether in form of copyright, patent, trademark and intellectual property right, ownership or other rights, shall not be reproduced, transferred, modified, amended or disseminated in any other forms, either in whole or in part, without written permission from MONOMAX. Violators shall be prosecuted pursuant to the law to the highest degree.

Members shall not let other persons to use the service, or resell the service or render service in a public manner, with or without compensation, or perform any conduct that could endanger the society, national security or public order, or could be in conflict with public order and morality, laws, or could cause damage against the service provider or other persons. If violation is found, the service provider has the right to suspend and/or terminate the service immediately. For contents, movies, series, TV programs published in MONOMAX service, MONOMAX allows members to watch for entertainment purpose only. No permission or consent is given for reproduction, modification or renting out or provision for the public to listen to and/or watch, or broadcasting, with or without compensation, or provision for publication by any means. Violators shall be prosecuted pursuant to civil and criminal laws.

15. Governing Laws

The interpretation and application of these terms and conditions of service shall be governed by Thai laws.
