Privacy Policy

Introduction

We, Mono Streaming Company Limited (“Monomax”), care about the privacy of Monomax customers, thus, we provide this privacy notice to inform Monomax customers of our policy in relation to the collection, use and disclosure of personal data or individual (“you”) in accordance with the Personal Data Protection Act B.E. 2562 (A.D. 2019) (“Personal Data Protection Act”).

This privacy notice informs you of how we collect, use or disclose your personal data, types of data, and our purposes, as well as details on how long we hold such data, third parties who we disclose your data to, your rights, what steps we will take to make sure your personal data stays private and secure, and how you can contact us.

This privacy notice applies to:

  1. Monomax Members or Customers
    • Individual customers
    • Our past and present customers who are individual
  2. Non-customers

These include individuals who have no product or service holding with us, but we may need to collect, use or disclose your personal data, e.g. anyone that visits Monomax website or applications, and anyone involved in other transactions with us or our customers.

1. How We Collect, Use or Disclose Your Personal Data

Monomax only collect, use or disclose your personal data where it is necessary or there is a lawful basis for collecting, using or disclosing it. This includes where we collect, use or disclose your personal data based on the legitimate grounds of legal obligation, performance of contract or conditions or terms of use made by you with us, our legitimate interests, performance under your consent and/or other lawful basis. Reasons for collecting, using or disclosing are provided below:

1.1. Monomax Legal Obligation

Monomax performs business under applicable laws and regulations. We are required to collect, use or disclose your personal data for various purposes in accordance with the laws, rules, regulations, and orders of any competent governmental and/or regulatory authorities, including but not limited to the following purposes:

  1. Compliance with Personal Data Protection Act;
  2. Compliance with laws e.g. computer crime laws, electronic transaction laws, securities and exchange laws, anti-money laundering laws, and other laws to which Monomax is subject both in Thailand and in other countries); and/or
  3. Compliance with regulatory obligations and/or orders of authorities (e.g. orders by any court or of governmental or regulatory authorities or competent officers).

1.2. Contract Made by You with Monomax

Monomax will collect, use or disclose your personal data in accordance with the request and/or agreement made by you with us, for the following purposes, including but not limited to:

  1. Consider providing products and/or services, and deliver our products and/or services to you including any activities that if we do not proceed, then our operations or our services may be affected or may not be able to provide you with fair and ongoing services;
  2. Authenticate when executing any transactions;
  3. Provide Monomax services via internet network, mobile applications and other online product platforms;
  4. Track or record your transactions;
  5. Notify you with transaction alerts;
  6. Recover the money which you owe (e.g. when you have not paid for your service fees and/or outstanding fees).

1.3. Our Legitimate Interests

Monomax will collect, use or disclose for the following purposes, including but not limited to:

  1. Manage our business operation and our financial business group companies’ business operation (e.g. to audit, conduct risk management, monitor, prevent, and investigate fraud, money laundering, terrorism, misconduct, or other crimes, including but not limited to carrying out creditworthiness checks of any persons related to our corporate customer);
  2. Conduct our relationship management (e.g. to serve customers, conduct customer satisfaction survey, handle complaints or other business operation);
  3. Develop and improve our products, services and systems to enhance our services standard and/or for maximum benefits in fulfilling your needs;
  4. Provide services to customers, ensure safety, investigate fraud, data storage, and back up data relating to our service provision;
  5. Obtain better understanding on how you access and use our services, improve our services, proceed in responding to customer needs and preferences, customize languages and space, provide assistance and notification in individual nature, or proceed other operation relating to the use of services by you and other customers;
  6. Improve advertisement and marketing activities, sales promotion activities available in or relating to our services more effectively;
  7. Check software or manage software improvement.

1.4. Your Consent

In certain cases, Monomax may ask for your consent to collect, use or disclose your personal data to maximize your benefits and/or enable us to provide services to fulfil your needs for the following purposes, including but not limited to:

  1. Members give consent for the Company to access, collect and use personal data which has been recorded or filled in the system or any document issued by government agencies, and/or collected by the Company from other sources or persons in accordance with applicable laws, date of birth, address, phone number, e-mail, Facebook, record of product or service purchase, as well as provision of information through inquiry or interaction with Monomax, such as feedback, critique and inquiry submitted by members in order to conduct research and analyze for maximum benefits in developing products and services to truly fulfil your needs and/or to contact you for offering products, services and benefits exclusively suitable to you;
  2. Send or transfer your personal data overseas, which may have inadequate personal data protection standards (unless the Personal Data Protection Act specifies that we may proceed without obtaining consent); and/or
  3. When you are classified as a minor, incompetent or quasi-incompetent person whose consent shall be given by their parents, guardian or custodian (as the case may be) (unless the Personal Data Protection Act specifies that we may proceed without obtaining consent).

2. What Personal Data We Collect, Use or Disclose

The type of personal data, namely personal data and sensitive personal data, which we collect, use or disclose, varies on the scope of products and/or services that you may have used or had an interest in. General personal data and sensitive personal data shall include but not limited to:

  1. Information you provide to us when opening account or using our services, such as name, surname, date of birth, gender, age, status, nationality, education, occupation, e-mail address, social media account and credit card information;
  2. Information you use with our services, including shared information that you send to other persons through our services, and information you store by using our services;
  3. Information you share with other users, which is sent to us, such as information provided in any thread, and communication between you and other users; and
  4. Information obtained from your use of the services, such as information about certain location, information about the use of service and public information; “location information” includes information we collect relating to your location (when you turn on location service), as well as location of your device when you use our services e.g. information from GPS, WiFi, compass, accelerometer, or detection of other movement in your device, IP Address of your device or internet service you are using to access our services.
  5. Other information you send to us or other persons that can identify your location or address, and shared information that you or other persons provide that can identify your location, such as location information embedded in photo you sent to use, and in the event that you have sent your location information to use earlier and you want us to delete such information, you are able to do so through our services.
  6. Personal, sensitive and religious information, such as blood type, biometric data (e.g. face recognition, fingerprint, voice recognition, and retina recognition), criminal record.
  7. Other information, such as record of interaction and communication between you and Monomax in any forms or methods, including but not limited to telephone, e-mail, conversation and communication through social media.

3. Sources of Your Personal Data

Normally, Monomax will collect your personal data directly from you, but sometimes we may get it from other sources, in such case we will ensure the compliance with the Personal Data Protection Act.

Personal data we collect from other sources may include but not limited to:

  1. Information obtained by Monomax from our group companies, business partners, and/or any other persons who we have relationship with;
  2. Information obtained by Monomax from persons related to you (e.g. your family, friends, referees);
  3. Information obtained by Monomax from corporate customers as you are director, authorized person, attorney, representative or contact person;
  4. Information obtained by Monomax from governmental authorities, regulatory authorities.

4. Your Rights

The Personal Data Protection Act aims to give you more control of your personal data. You can exercise your rights under the Personal Data Protection Act upon the effectiveness of the provisions in relation to rights of data subjects, with details as follows:

4.1 Right to Access and Obtain Copy of Your Personal Information

You have the right to access and obtain copy of your personal data holding by Monomax, unless we are entitled to reject your request under the laws or court orders, or if such request will adversely affect the rights and freedom of other individuals.

4.2 Right to Rectification

You have the right to rectify your inaccurate personal data and to update your incomplete personal data.

4.3 Right to Erasure

You have the right to request Monomax to delete, destroy or anonymize your personal data, unless there are certain circumstances where we have legal grounds to reject your request.

4.4 Right to Restrict

You have the right to request Monomax to restrict the use of your personal data under certain circumstances (e.g. when we are pending examination process in accordance with your request to rectify your personal data or to object the collection, use or disclosure of your personal data, or you request to restrict the use of personal data instead of the deletion or destruction of personal data which is no longer necessary).

4.5 Right to Object

You have the right to object the collection, use or disclosure of your personal data in case Monomax proceeds with legitimate interests basis or for the purpose of direct marketing, or for the purpose of scientific, historical or statistic research, unless we have legitimate grounds to reject your request (e.g. we have compelling legitimate ground to collect, use or disclose your personal data, or the collection, use or disclosure of your personal data is carried out for the establishment, compliance, or exercise legal claims, or for the reason of our public interests).

4.6 Right to Data Portability

You have the right to receive your personal data in case Monomax can arrange such personal data to be in the format which is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means. You also have the right to request Monomax to send or transfer your personal data to third party, or to receive your personal data which we sent or transferred to third party, unless it is impossible to do so because of technical circumstances, or we are entitled to legally reject your request.

4.7 Right to Withdraw Consent

You have the right to withdraw your consent that has been given to Monomax at any time pursuant to the procedures and methods prescribed by us, unless the nature of consent does not allow such withdrawal.

4.8 Right to Lodge a Complaint

You have the right to make a complaint with the Personal Data Protection Committee or their office in the event that Monomax does not comply with the Personal Data Protection Act.

5. How We Share Your Personal Data

Monomax may disclose your personal data to the following parties or organizations under the provisions of the Personal Data Protection Act:

  1. Group companies of Mono Next Public Company Limited, including Mono Shopping Company Limited, Mono Broadcast Company Limited, Mono Production Company Limited, Mono Cyber Company Limited, other group companies, associates, branch companies, related companies, financial business group companies of Monomax, business partners and/or other persons that Monomax has legal relationship, including our directors, executives, employees, staff, contractors, representatives, advisors and/or such persons’ directors, executives, employees, staffs, contractors, representatives, advisors;
  2. Government agencies and/or regulatory authorities;
  3. Business partners, representatives, suppliers, service providers, shops, strategic partners, contactors of Monomax in and outside the country, or agencies, independent auditors, financial institutions, where the disclosure of your personal data has specific purpose and under lawful basis, as well as appropriate security measures;
  4. Debt collection agencies, lawyers, credit bureau, fraud prevention agencies, courts, authorities or any persons whom Monomax is required or permitted by laws, regulations, or orders to share personal data;
  5. Third parties providing services to Monomax (e.g. market analysis and benchmarking), social media service providers (in a secure format) or other third-party advertisers so they can display relevant messages to you and others on our behalf about our products and/or services. Third-party advertisers may also use information about your previous online activities to tailor advertisement that may interest you;
  6. Your attorney, sub-attorney, authorized persons or legal representatives who have lawfully authorized power.

6. International Transfer of Personal Data

Under certain circumstances, it is necessary for Monomax to send or transfer your personal data internationally.

In those circumstances, Monomax will always exercise our best effort to have your personal data transferred to our reliable business partners, service providers or other recipients by the safest method in order to maintain and protect the security of your personal data, which includes the following circumstances:

  1. Comply with a legal obligation;
  2. Inform you the inadequate personal data protection standards of the destination country and obtain your consent;
  3. Comply with an agreement made by you with Monomax or your request before entering into an agreement;
  4. Comply with an agreement between Monomax and other parties for your own interest;
  5. Prevent or suppress any danger to your or other persons’ life, body or health when you are incapable of giving consent at such time; or
  6. Carry out activities relating to significant public interest.

7. Retention Period of Personal Data

Members agree and give consent for the Company to use their personal data throughout the term they remain members, and allow the Company to destroy or anonymize personal data within 90 days from termination of membership unless we cannot do so because it is necessary for us to maintain under any agreement involving other persons or as prescribed by laws.

8. Use of Personal Data for Original Purpose

Members agree and accept the collection, use and disclosure of personal data for the following purposes:

  1. To comply with agreement made between members and the Company, fulfill member’s request before entering into that agreement, comply with agreement between Monomax and other persons for the benefit of members, process information to improve the efficiency of products and services, arrange or market products, services and benefits, arrange sales promotion activities, research, analysis and marketing surveys, prepare statistical data, present new products or services for members as a whole;
  2. To process information to improve the efficiency of products and services, arrange or market products, services and benefits, arrange sales promotion activities, research, analysis and marketing surveys, prepare statistical data, present new products or services for individual members, whereby Monomax will use such data in accordance with the purposes and for maximum benefits for members.

In this regard, the collection and use of such data is in accordance with the criteria and policies specified by the company and permitted by applicable laws. Monomax is entitled to continue collecting and using your personal data, which has previously been collected by us before the effectiveness of the Personal Data Protection Act in relation to the collection, use and disclosure of personal data, in accordance with the original purpose. If you do not wish us to continue collecting and using your personal data, you may notify us to withdraw your consent at any time.

9. Security

Monomax endeavors to ensure the security of your personal data through our internal security measures and strict policy enforcement. The measures extend from data encryption to access protection measures. Monomax also requires our staff and third-party contractors to follow our applicable privacy standards and policies and to exercise due care and measures when using, sending or transferring your personal data.

10. How to Contact Us

Members are entitled to view and receive a copy of their personal data that the Company has collected, used and disclosed. If personal data has been obtained by the Company without members’ consent, members are able to request the Company to disclose the method of data acquisition. In the event that Monomax collects personal data from other sources, such as social media or websites, etc., members are entitled to request for deletion or destruction of information, suspension or anonymization of information. In the event that members terminate membership or Monomax does not use personal data in accordance with intended purposes, members are entitled to request for suspension of use, or request for correction of their personal data to ensure that it is correct, complete and up-to-date, by contacting the Company through communication channels as follows:

11. Effect of Not Providing Personal Data

Members are aware that failure to provide personal data will prevent them from becoming Monomax members.
